1. Introduction and Acceptance of Terms
Welcome to CMSGO.
These Terms & Conditions (“Terms”) govern all vehicle reservations, rentals and related services provided by CMSGO (“CMSGO”, “we”, “us” or “our”).
By making a reservation, completing payment, signing a rental agreement, accepting vehicle handover or using a CMSGO rental vehicle, the renter (“Renter”, “Customer”, “you” or “your”) acknowledges and agrees to these Terms.
Customers must review the applicable rental conditions, charges and optional protection arrangements before confirming a reservation.
CMSGO reserves the right to refuse or cancel a rental where a customer fails to meet the applicable eligibility, identification, payment or safety requirements, subject to applicable law.
2. Driver Eligibility Requirements
To rent a vehicle from CMSGO, the Renter must:
- Be at least 23 years old.
- Hold a valid and legally recognized driving licence appropriate for the rented vehicle.
- Provide accurate personal and contact information.
- Meet all applicable rental and insurance eligibility requirements.
- Present original identification and driving documents upon request.
Learner’s driving licences (L licences) and probationary driving licences (P licences) are strictly not accepted.
CMSGO reserves the right to refuse vehicle handover where the customer’s documents are invalid, expired, incomplete or cannot be satisfactorily verified.
3. Required Identification Documents
3.1 Malaysian Customers
Malaysian customers must provide:
- Valid Malaysian NRIC / MyKad.
- Valid Malaysian driving licence.
3.2 International Customers
International customers must provide:
- Valid passport.
- Valid domestic driving licence.
- International Driving Permit (IDP), as required under CMSGO’s rental conditions and applicable law.
Customers may be required to upload identification and driving documents through CMSGO’s authorized booking or verification channels.
The information provided must match the approved renter’s details.
4. Zero Security Deposit Policy
CMSGO offers Zero Security Deposit for eligible vehicle rentals.
No refundable security deposit is required for bookings expressly offered under this policy.
However, Zero Security Deposit does not mean Zero Liability.
The Renter remains financially responsible for applicable:
- Rental charges and optional LRO fees.
- Insurance excess fees and vehicle damage.
- Traffic summons, parking penalties and toll charges.
- Fuel shortages and refuelling costs.
- Smoking penalties and vehicle cleaning charges.
- Late return and extension charges.
- Lost keys, missing accessories or equipment.
- Towing, recovery and other legally recoverable costs.
The absence of a security deposit does not waive CMSGO’s right to recover amounts properly payable under the rental agreement.
5. Reservations and Online Payment
All reservations are subject to vehicle availability, successful payment and verification of rental eligibility.
CMSGO accepts payment through authorized online payment channels and official payment links only.
Cash payments are not accepted.
A booking is confirmed only after successful payment and confirmation by CMSGO.
Unpaid reservations may be automatically cancelled after the payment deadline displayed in the booking system.
Where the applicable payment deadline is 30 minutes, unpaid reservations may be automatically released after that period.
Customers must ensure that all contact and booking details provided are accurate.
6. Minimum Rental Period and Rental Charges
The minimum rental period is one (1) day.
CMSGO offers daily, weekly and monthly rental arrangements, subject to vehicle availability.
Rental charges are based on the selected vehicle, rental duration, pick-up and return arrangements and optional services.
The confirmed pick-up and return dates and times determine the agreed rental period.
Early returns do not automatically entitle customers to refunds for unused rental time.
Rental extensions require prior approval and payment of applicable additional charges.
7. Vehicle Collection and Return
The Renter must collect and return the vehicle at the confirmed location, date and time.
Vehicle delivery and collection arrangements are subject to operational availability and applicable location charges.
The Renter must inspect the vehicle upon collection and promptly report any existing damage or discrepancies.
Vehicle condition may be recorded through photographs, inspection reports or other reasonable methods.
The vehicle must be returned in substantially the same condition as when collected, allowing for reasonable wear and tear.
CMSGO reserves the right to inspect the vehicle upon return and assess applicable charges for damage, missing items, fuel shortages or excessive cleaning.
8. Fuel Policy
All CMSGO rentals operate on a Full-to-Full Fuel Policy, unless otherwise expressly stated.
Vehicles must be returned with a full fuel tank.
If a vehicle is returned with insufficient fuel, the Renter will be responsible for the missing fuel and any applicable refuelling service charges.
The Renter must use the correct fuel type recommended for the vehicle.
Damage caused by incorrect fuel usage may be charged to the Renter.
9. Mileage Policy
Daily and weekly rentals are subject to any mileage allowance disclosed in the applicable booking details.
Monthly car rentals include unlimited mileage, unless otherwise expressly agreed in writing.
Unlimited mileage does not permit unauthorized commercial use, prohibited driving activities or cross-border travel.
10. Authorized Drivers
Only drivers approved by CMSGO and recorded in the rental arrangement are permitted to operate the vehicle.
The Renter must not allow unauthorized, unlicensed or ineligible persons to drive.
Additional drivers must satisfy the applicable eligibility and verification requirements.
The Renter remains responsible for breaches of these Terms arising from vehicle use by persons to whom the Renter provides access.
11. Geographical Restrictions
CMSGO rental vehicles are permitted for use within Peninsular Malaysia (West Malaysia) only.
Cross-border travel is strictly prohibited.
Vehicles must not be driven into Singapore, Thailand or any other country.
Unauthorized cross-border travel constitutes a material breach of the rental agreement.
The Renter may be responsible for resulting recovery costs, vehicle damage, insurance consequences and other legally recoverable losses.
12. Prohibited Vehicle Use
The Renter must not:
- Use the vehicle for unlawful activities.
- Drive under the influence of alcohol or drugs.
- Allow unauthorized or unlicensed persons to drive.
- Participate in racing, speed trials or dangerous driving.
- Use the vehicle for unauthorized off-road activities.
- Sublet, sell, pledge or transfer possession of the vehicle.
- Use the vehicle for e-hailing, delivery or commercial transportation without written approval.
- Transport prohibited or hazardous materials.
- Tamper with vehicle tracking or safety equipment.
- Drive outside the permitted geographical area.
- Intentionally damage or misuse the vehicle.
Any material breach may result in rental termination, lawful vehicle recovery and liability for applicable losses.
13. Insurance and Customer Financial Responsibility
CMSGO rental vehicles are subject to the applicable vehicle insurance arrangements.
Insurance coverage, exclusions and excess amounts may vary according to the vehicle, rental agreement and circumstances of an incident.
The Renter acknowledges that insurance does not necessarily eliminate personal financial liability.
Where applicable, the Renter may be responsible for an insurance excess, uninsured losses and other charges permitted under the rental agreement and Malaysian law.
CMSGO offers optional Liability Reduction Options (LRO) to reduce the applicable excess amount for eligible incidents.
14. Liability Reduction Options (LRO)
14.1 What Is LRO?
LRO stands for Liability Reduction Options.
LRO is an optional paid contractual protection arrangement designed to reduce the Renter’s applicable financial liability in the event of an eligible accident or insured vehicle damage.
LRO is not a refundable security deposit and is not a standalone insurance policy.
Customers may select LRO during the reservation process.
14.2 Customers With LRO
Customers who purchase LRO benefit from the reduced applicable excess fee shown in the following schedules.
The reduced excess applies only to eligible incidents and remains subject to the rental agreement, applicable insurance conditions, exclusions and reporting requirements.
LRO must be purchased and confirmed before the relevant incident occurs.
14.3 Customers Without LRO
Customers who do not purchase LRO are subject to the higher applicable excess fee listed under Excess Fee without LRO, where an eligible claim gives rise to an excess.
The Renter acknowledges that declining LRO may result in greater financial exposure.
Actual liability depends on the circumstances, applicable insurance conditions, documented losses and Malaysian law.
14.4 Vehicle Segment — LRO Charges and Excess Fees
| Vehicle Segment | Excess Fee with LRO (MYR) | Excess Fee without LRO (MYR) | LRO per Day (MYR) |
|---|---|---|---|
| Group A | 2,500 | 5,000 | 30 |
| Group B | 4,500 | 9,000 | 45 |
| Group C | 6,000 | 13,000 | 50 |
| Group D | 8,500 | 17,000 | 60 |
The LRO daily charge is an optional protection fee and is separate from the vehicle rental charge.
The total LRO fee will be calculated based on the applicable daily rate and the chargeable rental period, as disclosed during booking.
14.5 Vehicle Group — LRO Charges and Excess Fees
Where CMSGO classifies rental vehicles under Groups A, B, C or D, the following schedule applies:
| Vehicle Group | Excess Fee with LRO (MYR) | LRO per Day (MYR) |
|---|---|---|
| Group A | 2,500 | 30 |
| Group B | 4,500 | 45 |
| Group C | 6,500 | 50 |
| Group D | 8,500 | 60 |
The applicable vehicle segment or group will be determined by the booked vehicle and stated in the relevant booking details or rental agreement.
The segment and group schedules are alternative classifications and shall not result in duplicate charges.
Where a group schedule does not specify an excess fee without LRO, the applicable amount must be separately disclosed before the booking is confirmed.
14.6 LRO Exclusions
LRO may not apply in circumstances involving:
- Driving under the influence of alcohol or drugs.
- Driving by unauthorized or unlicensed persons.
- Unauthorized cross-border travel.
- Illegal or prohibited vehicle use.
- Deliberate damage or reckless misconduct.
- Material breaches of the rental agreement.
- Failure to comply with applicable accident reporting or claims procedures.
- Other exclusions expressly disclosed under the applicable insurance or protection terms.
Where LRO is unavailable or excluded, the Renter may remain liable for applicable losses and charges to the extent permitted by law.
14.7 LRO Refund Policy
LRO charges are generally non-refundable once the rental has commenced.
For cancellations before collection, any refund entitlement is subject to the applicable cancellation policy and mandatory legal requirements.
14.8 Important Acknowledgement
Zero Security Deposit does not mean Zero Liability.
By selecting or declining LRO, the Renter acknowledges the applicable excess fee structure and agrees to the relevant protection terms.
15. Accidents, Damage and Police Reports
In the event of an accident, collision, theft, vehicle damage or other serious incident, the Renter must:
- Stop safely and take reasonable steps to prevent further injury or damage.
- Contact emergency services where necessary.
- Notify CMSGO as soon as reasonably possible.
- Make a police report within 24 hours, where required under the applicable rental and insurance conditions.
- Provide photographs, accident details and supporting documents.
- Cooperate with CMSGO, the insurer and relevant authorities.
- Obtain CMSGO’s approval before arranging repairs or settlements on its behalf.
Failure to comply with applicable reporting and claims requirements may affect insurance or LRO benefits.
16. Vehicle Damage and Recovery Charges
The Renter may be responsible for vehicle damage, loss or expenses arising during the rental period, subject to the rental agreement, insurance arrangements and Malaysian law.
Recoverable amounts may include:
- Vehicle repair costs.
- Applicable insurance excess.
- Uninsured losses.
- Towing and vehicle recovery charges.
- Replacement of lost keys or accessories.
- Cleaning and restoration expenses.
- Other documented and legally recoverable losses.
CMSGO may use vehicle inspection records, photographs, invoices and other supporting documents when assessing damage-related charges.
Charges must not result in an unlawful or unjustified duplicate recovery for the same loss.
17. Traffic Summons, Parking and Toll Charges
The Renter is responsible for traffic offences, parking penalties, toll charges and other applicable penalties arising from the use of the rental vehicle during the rental period, subject to law.
Where legally required or permitted, CMSGO may provide relevant driver information to the Road Transport Department (JPJ), police or other competent authorities.
The Renter agrees to cooperate with reasonable requests for driver identification and enforcement information.
18. Smoking and Vehicle Cleanliness
Smoking and vaping are strictly prohibited inside all CMSGO rental vehicles.
18.1 Smoking Penalty
A RM300 smoking penalty will apply if smoking or vaping occurs inside the rental vehicle, subject to applicable law.
18.2 Cleanliness Fees
Customers must return the vehicle in a reasonably clean condition.
Where excessive dirt, stains, spills, unpleasant odours or other conditions require additional cleaning, a cleanliness fee ranging from RM30 to RM200 may apply, depending on the severity and cleaning work required.
Reasonable wear and ordinary use will not automatically result in cleaning charges.
CMSGO may document the vehicle condition through photographs or inspection records.
19. Late Return and Rental Extensions
Vehicles must be returned by the agreed return date and time.
Late Return Fee: RM100 per hour.
The late return fee applies to unauthorized returns after the agreed return time.
Any partial hour of delay may be charged as one full hour, where disclosed in the rental agreement.
Customers requiring additional rental time must contact CMSGO and obtain approval before the agreed return time.
Extensions are subject to vehicle availability and payment of applicable additional charges.
Payment of late return fees does not automatically extend the rental agreement or authorize continued vehicle use.
Any additional loss or recovery charge must be legally recoverable and must not duplicate compensation for the same loss.
20. Cancellation and Refund Policy
Cancellation requests must be submitted through CMSGO’s official communication channels.
Unless otherwise expressly agreed:
20.1 Cancellation More Than 48 Hours Before Pick-up
A 10% cancellation fee will be deducted from the applicable refundable booking amount.
The remaining eligible amount will be refunded through the appropriate payment method.
20.2 Cancellation Within 48 Hours Before Pick-up
Cancellations made within 48 hours of the scheduled pick-up time are non-refundable.
20.3 Optional Protection Charges
Optional insurance or LRO charges are non-refundable, subject to applicable law and any expressly agreed exception.
20.4 Last-Minute Cancellation and Rental Credit
At CMSGO’s discretion, an eligible booking amount may be retained as rental credit valid for up to 12 months from the date of issue, subject to written confirmation and applicable conditions.
20.5 Refund Processing
Approved refunds will be processed through the appropriate payment method.
The time required for funds to be returned may depend on the relevant payment provider or financial institution.
Nothing in this policy excludes mandatory consumer rights or remedies under applicable law.
21. No-Show Policy
A booking may be classified as a No-Show where the Renter fails to arrive for vehicle collection or fails to complete the required handover arrangements.
A confirmed No-Show booking is non-refundable and cannot be rescheduled, subject to applicable law.
CMSGO may release the reserved vehicle once the booking is determined to be a No-Show.
Failure to provide required identification documents or satisfy rental eligibility requirements may result in refusal of vehicle handover, subject to the applicable booking conditions.
22. Vehicle Availability and Replacement
Reservations are subject to vehicle availability and operational circumstances.
If the reserved vehicle becomes unavailable due to mechanical failure, accident or other unforeseen circumstances, CMSGO may offer a reasonably comparable replacement vehicle.
Where a suitable replacement cannot be provided, CMSGO will discuss an appropriate alternative or refund in accordance with applicable law and the circumstances.
23. Mechanical Breakdown and Roadside Assistance
Customers must notify CMSGO promptly if a vehicle develops a mechanical fault or becomes unsafe to operate.
The Renter must not continue driving where doing so would create an unreasonable safety risk or cause further damage.
Roadside assistance, towing and replacement arrangements are subject to availability and the circumstances of the incident.
Where breakdown or damage results from misuse, negligence, incorrect fuel or prohibited conduct, the Renter may be responsible for applicable repair and recovery expenses.
24. Personal Belongings
The Renter is responsible for safeguarding personal belongings inside the rental vehicle.
CMSGO is not responsible for loss of or damage to personal belongings except where liability arises under applicable law.
Customers should remove all personal belongings before returning the vehicle.
25. Personal Data Protection
CMSGO collects and processes personal information for identity verification, booking administration, rental operations, payment processing, insurance matters and other legitimate purposes.
Personal data is handled in accordance with our Privacy Policy and applicable Malaysian data protection legislation.
Please refer to:
26. Breach and Termination
CMSGO may terminate a rental agreement where the Renter materially breaches these Terms, provides fraudulent information, engages in prohibited activities or creates a serious safety or legal risk.
Where permitted by law, CMSGO may recover the rental vehicle and seek payment of applicable outstanding charges, losses and recovery expenses.
27. Limitation of Liability
To the extent permitted by Malaysian law, CMSGO will not be responsible for indirect or consequential losses arising from circumstances outside its reasonable control.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or restricted.
28. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia.
The parties should attempt to resolve disputes through good-faith communication.
Where a dispute cannot be resolved amicably, it may be referred to the courts or other competent dispute resolution bodies in Malaysia, subject to applicable law.
29. Changes to Terms and Conditions
CMSGO may update these Terms to reflect changes in its services, operations or legal requirements.
The Terms applicable to a booking will generally be those disclosed when the booking is confirmed, unless a lawful variation is agreed.
Updated Terms will be published on the CMSGO website.
